Nursing Malpractice
Nursing Malpractice is a specific type of medical malpractice and can occur in hospitals, doctor’s offices, nursing homes and other medical care facilities.
Nurses have taken over much of the care assessment and planning management for patients and a nurse’s responsibility involves more clinical judgment than ever before. If a nurse fails to report to the doctor a change in the physical condition of a patient, administers incorrect medication dosages or fails to administer medication when needed, the nurse may be held liable in a nursing malpractice case. Establishing that there was a patient-nurse relationship and often obtaining testimony from an expert witness is fundamental in proving nursing malpractice. An expert witness is another medical professional, usually a physician, who is willing to provide expert opinion and testimony of malpractice.
